Terms of use and of sale

1. Purpose
These terms govern the use of the Levarka service, available at levarka.com, published by Emmanuel Latour, sole trader, 13 rue Pavée, 77600 Bussy-Saint-Georges, registered 850 427 014 R.C.S. Meaux.
The service compresses a PDF file, then makes it available to a recipient through a share link or by email.
2. Access to the service
Using the free plan requires no account. A verified email address is asked for only when a link is sent by email.
The publisher may suspend access for maintenance, a security incident or abusive use.
3. What the user agrees not to do
The user must not upload or pass on:
- illegal, infringing or defamatory content, or content harming the rights of others,
- child sexual abuse material or content glorifying terrorism,
- files containing malicious software,
- content meant for unsolicited sending or for phishing attempts.
The user warrants holding the rights needed over the documents uploaded. Any breach leads to the immediate deactivation of the link, the deletion of the file, and where appropriate a report to the competent authorities.
4. Technical limits
- Free plan: 100 MB per file, 24 hour retention, 3 email sends per day.
- Professional plan: 2 GB per file, retention up to 30 days, email sends with no limit beyond reasonable use, download tracking.
Compression lowers the resolution of images and may therefore affect their sharpness. Text and vector elements are not reinterpreted. When no gain is possible without loss, the original file is returned.
5. Automatic deletion
When the applicable period ends, the file, the share link and the associated data are deleted for good. No recovery is possible after expiry. It is up to the user to keep a copy of their documents.
6. Professional plan, price and payment
The Professional plan is offered at 12 € per month. VAT not applicable, article 293 B of the French General Tax Code.
Payment is made by bank card, through Stripe. No card data is kept by the publisher.
The subscription renews automatically at each term, until cancellation.
7. Cancellation
The subscriber may cancel at any time, without reason, from their space. Cancellation takes effect at the end of the period already paid for, which remains due. Transfers already under way keep their expiry date, later transfers go back to the limits of the free plan.
8. Right of withdrawal
A consumer has fourteen days to withdraw from a contract concluded at a distance.
By asking for the service to start immediately, the consumer acknowledges waiving the right of withdrawal for the part of the service already performed, under article L221-25 of the French Consumer Code.
9. Liability
The service is provided with reasonable means to keep it available and secure, without any guarantee of uninterrupted availability.
The publisher cannot be held liable for the loss of a document not kept elsewhere, for the use of a share link passed on by the user to a third party, nor for the effects of compression on the quality of a document.
Nothing in these terms limits the rights granted to consumers by law.
10. Personal data
Data processing is described in the privacy policy, reachable from the footer of the site.
11. Changes to these terms
The publisher may change these terms. Subscribers are told by email, and may cancel free of charge if the change is unfavourable to them.
12. Governing law and disputes
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. A consumer may use the consumer mediator named in the legal notice.
